Conspiracy Crimes
Conspiracy is defined as an agreement between two or more people to commit a crime or accomplish a legal purpose through illegal actions. The crime in conspiracy lies not necessarily in the implementation of this crime, only that the agreement had been made to commit the crime at some future date and some effort had been exhibited towards the completion of the crime. So even if no criminal act took place, a person could still be charged with conspiracy because they conspired with others regarding criminal activity and made an effort towards completing the crime. In order for a person to be convicted of conspiracy, the prosecuting attorney will have to prove the following:
- That two or more people, in some way or manner, came to a mutual understanding to try to accomplish a common and unlawful plan.
- That the person willfully became a member of such conspiracy.
- That one of the conspirators during the existence of the conspiracy knowingly committed at least one of the methods (overt act) described in the indictment.
- That an overt act was knowingly committed to accomplish some object of the conspiracy.
Conspiracy charges can be applied in conjunction with the following types of crimes:
- Drug Crimes
- Murder
- Prostitution
- Fraud
- Bribery
- Burglary
- Pyramid Schemes
- Kidnapping
